RESIDENT DOCTORS ASSOCIATION MEMBERS SUE DR SAMPA FOR ABUSE OF OFFICE

MEMBERS of the Resident Doctors’ Association of Zambia (RDAZ) have sued their president Brian Sampa in the Lusaka High Court for abusing his authority and squandering K244,860 belonging to the association without justification.

According to a report published by The Mast, RDAZ members are seeking an order compelling Dr Sampa to render an account of the association’s finances and to pay back all the money which is unaccounted for.

The members also want an injunction restraining Dr Sampa from interfering with the holding of the extra ordinary meeting by the general assembly.

In their statement of claim, Bekilizwe Mshanga and others said according to the provisions of the RDAZ constitution, the annual general meeting is the supreme organ of the association at which elections to the executive body are held and at which various policies of the association are made.

They said the constitution, among other things, provides for the procedures relating to discipline and suspension of members of the association.

Mshanga and other members contended that since his election, Dr Sampa has been abusing his powers, contrary to the provisions of the association’s constitution, which has resulted in the membership losing confidence in him.

“In May 2021, in an act of abuse of power and contrary to the laid down constitutional provisions relating to disciplinary procedure, Dr Sampa suspended executive members from being members of the executive without following constitutional procedures and subsequently prevented them from carrying out any of their constitutional mandate which frustrated them and caused them to resign,” the members stated.

“By his unconstitutional manoeuvres, the defendant up to date solely carries out all executive committee functions contrary to the provisions of the constitution. In his continued abuse of power and office, in June and July 2021 the defendant unlawfully and without justifiable cause withdrew funds for the association amounting to K244, 860.”

Mshanga and others stated that following a protest from the general membership over the unjustified withdrawal, Dr Sampa proceeded to block all members who at the time were receiving notifications relating to the withdrawals.

“Efforts by the general membership to have Dr Sampa account for the K244,860 and other withdrawals made proved futile, and no audited accounts have been given even after an extra ordinary meeting was held for him to render a report sometime in September and October 2021; and the report was rejected by the membership,” Mshanga said.
