THE Court of Appeal has halted proceedings before the High Court in a matter where Joseph Malanji and Bowman Lusambo have petitioned the Electoral Commission of Zambia and the State over the decision by returning officers to declare inavild their nominations for the Kwacha and Kabushi parliamentary by-elections.
This is according to an exparte order granted to the State and the Electoral Commission of Zambia dated September 16, 2022 staying the proceedings pending determination of their appeal against the High Court’s ruling of September 15 in which it declined to refer the matter to the Constitutional Court, among other applications.
“Upon hearing the first applicant and upon reading the affidavit in support thereof, it is hereby ordered that the High Court proceedings under cause number 2022/HP/1327 be and are hereby stayed,” read the order.
The court has further directed that it will hear the application on September 22, 2022 at 14:00 hours.
