The Constitutional Court has found that the High Court was on firm ground when it found that there was violence on three occasions in Kabushi and lawmaker Bowman Lusambo was present at the time.
Judge Palan Mulonda has further found that the lower court was on firm ground that it was not a mere coincidence that Mr Lusambo was found with the Nato Forces, who perpetrated violence prior to the August 12 elections.
The Court has also found that Mr Lusambo gave out K300 to some congregants at St Kizito Catholic church on the eve of elections and promised to give them mealie meal, a move in breach of the Electoral Process Act.
