A 14-YEAR-OLD girl believed to have been impregnated by her father, a Zambia Air Force (ZAF) sergeant, was allegedly found having s£x with her cousin in the living room.
A magistrate heard that the victim, whom we shall refer to as Chisoni, was allegedly copulating with her 20-year-old cousin, pseudonym Chisha, around 20:00 hours.
Chisoni’s uncle, Joshua (not real name), told magistrate Kawama Mwamfuli that when he found the two in the act, he asked them to stop what they were doing.
“On March 29, 2024, I was coming from school around 20:00 hours, when I arrived home…I found [Chisoni] and [Chisha] having s£x in the sitting room. The mother [to Chisoni] was not around, she had gone to order some charcoal,” Joshua said.
This is in a case the father of Chisoni, whom we shall call sergeant K, is charged with incest.
It is alleged that in August last year, he had s£x with Chisoni while knowing she is his biological daughter.
He denied the claim and the prosecution called several witnesses, who testified against him – including the victim and his wife.
The court later found the 41-year-old with a case to answer and placed him on his defence, in which he claimed that he was just implicated by some of his dependants.
Sergeant K testified that his daughter was reported to be having an affair with Chisha.
During continued defence, Joshua, who is Seargent K’s younger brother, said during the material time, he lived with the accused in the house, which had 11 occupants.
“…from what I saw, what was happening in the house, it is not the accused who impregnated the daughter,” he said.
As trial continued, Joshua said there were 11 people in the house – which included four men aged above 18 years, including Chisha.
“Chisha had a relationship with Chisoni,” Joshua said.
He later narrated how he found Chisoni and Chisha having s£x on the sofa while one of their female relatives was seated by a door in the house.
The witness also said that Chisoni and Chisha would move together when going to school.
In cross-examination, Joshua admitted not having told Chisoni’s mother that he found her having s£x with Chisha.
