Another mining company, Kalengwa Processing Zone Limited, has dragged Moxico Resources Zambia and Euro Africa Kalengwa to court demanding US$16 million.

This is the second major lawsuit Moxico and Euro Africa Kalengwa are facing after Kalengwa Mineral Processing Limited sued them for $20 million over a mine.

In a writ of summons filed at Kitwe High Court on Tuesday, April 25, KPZ is demanding payment of $16 million being damages, costs and losses occasioned to Kalengwa Processing Zone Limited from its mining rights, capital and investments over the mine in Mufumbwe.

The mining firm states that this was directly occasioned by the Order of Interim Injunction obtained by the Defendants against the Plaintiff under Cause No. 2019/HÌxI/1 86 which injunction Order restrained the Plaintiff from conducting its exploration mining activities over the tenement it held an exploration licence for at the time, thereby making the Plaintiff suffer the claimed damages.

It is also claiming an order for damages arising out of demurrage charges and costs for hired Exploration and Drilling expenses and other exploration materials when the it was ejected from the tenement on account of the Injunction Order obtained against it by the Defendants.

Kalengwa Processing Zone Limited also claims interest on all sums due, any other further relief the Court shall deem fit and costs.

“You are commanded in the President’s name that within 14 days after the service of this Writ on you, inclusive of the day of such service, you do cause an appearance to be entered for you in an action at the suit of: Kalengwa Processing Zone Limited and take notice that in default of your so doing the plaintiff may proceed therein, and judgement may be given in your absence,” read the writ.
